Right of Withdrawal and Goods Return Policy

Right of Withdrawal and Goods Return Policy

1. Right of Withdrawal

The consumer has the right to withdraw from a distance contract concluded through the online store www.parkets.eu  within 14 days without giving any reason, except in cases provided for by applicable laws and regulations.

In the case of purchasing goods, the withdrawal period expires 14 days after the day on which the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the goods. If goods from a single order are delivered separately, the period is calculated from the receipt of the last item.

2. Procedure for Exercising the Right of Withdrawal

To exercise the right of withdrawal, the consumer must inform SIA “EKO PROJEKTS” of their decision by means of an unequivocal statement before the withdrawal period expires, sending it by email to info@parkets.eu  or by post to: Mārupes iela 39-17, Riga, LV-1002, Latvia.

The consumer may use the model withdrawal form provided for by applicable laws and regulations; however, its use is not mandatory. It is sufficient for an unequivocal withdrawal statement to be sent before the withdrawal period expires.

3. Return of Goods

After sending the withdrawal statement, the consumer must return or hand over the goods to SIA “EKO PROJEKTS” without undue delay and no later than 14 days thereafter. The deadline is met if the goods are dispatched before the 14-day period expires.

Return address: Rīgas iela 67, Jelgava, LV-3004, Latvia. Before delivering palletised or oversized goods to the warehouse, please arrange an acceptance time by emailing info@parkets.eu  or calling +371 29223531. This arrangement does not restrict the statutory return period.

4. Transport Costs for Returning Goods

If the consumer exercises the right of withdrawal, the consumer bears the direct costs of returning the goods, except where SIA “EKO PROJEKTS” has agreed to bear those costs or applicable laws and regulations provide otherwise.

Goods that, due to their size, weight or characteristics, cannot normally be returned by post (for example, palletised mulch, briquettes or pellets) must be returned using suitable transport. Information on the costs of returning such goods is provided to the consumer before the order is confirmed: [INSERT A SPECIFIC ESTIMATED AMOUNT OR A COST CALCULATION COMPLIANT WITH APPLICABLE REGULATIONS].

If the consumer wishes the company to arrange return transport, the parties may agree separately on this service and its costs.

5. Refund of Payments

If the consumer exercises the right of withdrawal, SIA “EKO PROJEKTS” shall refund all payments received, including the original standard delivery costs, without undue delay and no later than 14 days after receiving the withdrawal statement. Additional costs resulting from the consumer's choice of a more expensive delivery method do not have to be reimbursed.

The company may withhold the refund until it has received the goods or the consumer has supplied evidence of having sent the goods back, whichever occurs first, unless the company has offered to collect the goods itself.

The refund shall be made using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed otherwise. No additional fee shall be charged for the refund.

6. Inspection of Goods, Diminished Value and Set-off

The consumer may inspect the nature, characteristics and functioning of the goods to the extent necessary to become familiar with them, in a manner similar to what would be permitted in a physical store.

The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning, subject to the conditions laid down in Section 12, Paragraph eleven of the Consumer Rights Protection Law, including the requirement to provide proper information about the right of withdrawal.

In the case of packaged mulch, briquettes, pellets and similar goods, depending on the actual circumstances, excessive handling may include scattering the material, mixing it with other materials, or using it in a way that causes demonstrable material loss or contamination. Opening the packaging does not, in itself, automatically constitute a reduction in value.

If a reduction in the value of the goods caused by the consumer's handling is objectively established and proven, the company may claim compensation for that reduction in accordance with applicable laws and regulations.

Set-off of mutual claims. If the company has a legally justified, demonstrable claim against the consumer for diminished value of the goods that is eligible for set-off, SIA “EKO PROJEKTS” may apply a set-off of mutual claims in accordance with Sections 1846–1854 of the Civil Law, provided that all legal requirements are met. The consumer shall be informed in writing of the grounds, amount and calculation of the set-off. This provision does not create an automatic right to make deductions and does not restrict the consumer's statutory right to a refund.

7. Non-conformity of Goods with the Contract

The procedure for exercising the right of withdrawal does not restrict the consumer's right to submit a claim concerning goods that do not conform to the terms of the contract. Such claims shall be handled in accordance with the Consumer Rights Protection Law, including Sections 27 and 28 thereof.
